Artist Contract.


The contract is a clear, respectful agreement between The Show Up Movement and the artists we collaborate with.

Context

The Show Up Movement aims to produce high quality, ethically printed clothing that encourages real world connections where the clothing becomes a talking point. The wearer is given the opportunity to talk about positive actions they take (showing up) in the hopes of inspiring others to do the same.

We are partnering with artists to provide a wide range of designs that follow set themes and that appeal to a broad range of styles.

This document discusses how this artwork will be used, the communications between us and the artist and full details on commission payments. 

Why

The artists are at the heart of The Show Up Movement. We’re adopting a collaboration and commission-based model to encourage shared promotion, deeper connection and to increase the reach of the movement.

Usage

The primary use of the artwork is the clothing, initially t-shirts but with planned expansion to other clothing items. Other usages include imagery on our website and sales platforms and on social media for promotional purposes. 

We will never sell the artwork directly.

The artist retains all copyright and ownership of the artwork which is provided to The Show Up Movement in a temporary, non-exclusive worldwide license. 

Credit

Wherever the design is displayed, the artist’s details will accompany the artwork, we will link to the artist's social media account (or other links as requested) at every stage of the promotion.

Mockups

For illustration and sales purposes, we will create mockups using the artist’s design work. The mock ups will be used on social media and on sales platforms. 

We will provide copies of the mockup for approval before they are published. Designs will not be published until sign off is received via email. Once the mockup is signed off, the artist will be given a copy which they can use however they wish. We would politely ask for credit but it is not mandatory.

Product branding

Each clothing design will have a variation of The Show Up Movement logo on it, this logo is designed to be subtle, allowing the artwork to be prominently displayed and the focal point of the product. During the design phase, the artist may add their signature, logo or branding to the design, we ask that this is done in a way that it doesn’t distract from the main design.

Values

Our artists should read our brand pack and understand our values. We believe that our partnered artists should be aligned to these and will represent our brand in accordance with these values.

It therefore should go without saying that we will not use artwork that uses hate speech, discrimination or similar themes. 

If we have any concerns over the artwork, we will discuss this with you in an open and honest way. We will jointly agree on the next best steps. 

Product launches

The Show Up Movement will offer a variety of designs at any one time, we may have limited runs of a design or ones that remain available for longer. We will remain in discussion with the artists to agree on release dates, runs times and unit availability. We will be artist led, if the artist wishes to coincide the launch with a particular event, we will try to accommodate that. 

Product usage

Once the clothing range is printed, we will have promotional photos taken to support online activities. The products will then be available for online purchase. We may also look into physical sales through markets and local retailers. Any sales plans will be agreed by the artist before being committed to. 

We also plan to have some promotional giveaways to increase our reach, this may include a free T-shirt or stickers for celebrated and featured supporters. 

This will be discussed prior to any commitments made to ensure agreement. 

Of course, the artist will receive a T-shirt if they want it! This will be offered at cost price or better.

Communication

We aim to communicate via email to ensure that all discussions are tracked. Where communications are outside of email, we will follow up via email to track conversations and agreements. Our email address is simon@theshowupmovement.co.uk.

Termination

In the event that either The Show Up Movement or the artist wish to terminate the partnership, the following actions will be taken:

Online sales cease.

Online promotions cease (we’ll consider deleting past posts if required)

We would ask for an open and honest conversation to resolve any issues that may arise. We want to work closely with our artists and will be respectful to their needs.

In the event that we have surplus stock that will no longer be sold, where possible, we will donate to local charities to avoid products going into landfill. 

At the point of termination, any licensing rights will be removed from The Show Up Movement.

Data storage

For auditing purposes and to comply with regulations, we will retain personal details as needed. This will conform with GDPR and will be transparent at all times and will never be shared with 3rd parties.

Commission

Artist commission will be paid per unit sold. The full details of this will be discussed and agreed before promotion of designs begins. The artist is responsible for reporting and paying any personal or business taxes related to commission payments. The Show Up Movement will not deduct tax or provide tax advice.

Liability 

We ask that all artwork shared with The Show Up Movement is original and created by the artist. We ask the artist to ensure they have the right to use any design elements, such as fonts or textures.

The Show Up Movement will be using a 3rd party for printing, we will perform quality checks before sending garments, we cannot be held responsible for any delays.

The Show Up Movement cannot commit to sales figures, we will be transparent about sales at all times. 

Charity donation

Charity donations will be managed by The Show Up Movement and will be paid monthly. The Show Up Movement reserves the right to change charity partnerships and our operating model, but we are committed to our charity work, it’s a fundamental part of our operating model. All charity support will be transparent to the artist and the charities, donation information will be public.

Disputes

If something isn’t working, or doesn’t feel right, please get in touch as soon as possible. We will aim to resolve any issues raised. This is a partnership, we rely on good working relationships and we promise to always operate in a way that respects the artist.
